DescriptionJoseph Holt, Judge Advocate General in a report to President Lincoln reviewed the court martial proceedings, findings and sentence in the trial of Major General Fitz John Porter charged with disobeying orders from his commander, General Pope, during battle near Manassas between Aug. 27-29, 1862. Porter's claim that he had it on good authority to believe his army "was pushed out to save the army of the Potomac"an army that could take care of itself" made it appear that his retreat was premeditated. There was testimony to confirm this. However, Judge Holt remarks the defendant may have had considerations of self-preservation as well as patriotism. Based on the defendant's prior good reputation, the usual sentence of death was not handed down. General Porter was "cashiered and barred" from holding any office or position within the Government of the U.S.
